The Loan Agreement and the provision of any loan or related service by Skystone through PEL:
Is entered into solely between the Borrower and PEL/Skystone, and confers no rights or obligations on any third party;
Does not create any fiduciary relationship, joint venture, partnership, or agency between PEL/Skystone and any borrower or third party;
PEL/Skystone is not liable for any contractor, agent, or third-party services engaged by the Borrower and is under no duty to inspect or monitor such services.
